Inadequate influence exerted on a probation counsellor

A person sentenced to 160 hours of community service for domestic violence, attempted to provide an amount of money to a probation counsellor from Chisinau in order not to serve a sentence imposed by the court.

The convicted person presented under summon to the Probation Office at the first meeting, being informed about the procedure and conditions for execution of the penalty. The person received under signature its rights and obligations and was informed about the consequences of non-execution of the sentence. The person said that it doesn’t want to serve the sentence and proposed to the probation counsellor an amount of 200 euros to delay the execution of the sentence imposed by the court.

Therefore, the probation counsellor notified the Legal Department of the Central Probation Office in accordance with the Regulation on the evidence of the undue influence cases. Also it was notified the National Anticorruption Centre, according to its competence.

As a result of the special investigative measures, the convict was caught red-handed by the officers of the National Anticorruption Centre. If it will be found guilty, the suspect could face a prison sentence up to 6 years and a fine of 2,000 to 4,000 contravention units, according to the art. 325 (1) of the Criminal Code and will be taken into account at the application of the sentence also the art. 85 of the Criminal Code.
