The Legal Directorate was established to provide the legal activity of the Central Probation Office with its territorial subdivisions and uniform compliance of legislation, being an independent structural subdivision within the Central Probation Office, which is headed by the chief of the Directorate and is subordinated directly to the head of the Central Probation Office.
In its activity, the Legal Directorate is guided by the Constitution, laws of the Republic of Moldova, and decrees of the President, the decisions and orders of the Government, international treaties to which the Republic of Moldova is party.
The Legal Directorate has the following main duties and functions:
a) develops or participates in the development ( analyses performed legal expertise ) of the draft laws and decrees of the President of the Republic of Moldova, of the decisions and ordinances of the Government of the Republic of Moldova and other normative acts elaborated by the probation office;
b) performs the legal expertise of the draft orders, instructions, resolutions, orders and other normative acts of the Central Probation Office;
c) develops independently or jointly with other structural subdivisions the proposals or repeal orders and other normative acts of the Central Probation Office;
d) prepares independently or jointly with other structural subdivisions of the Central Probation Office opinions on the draft normative acts addressed to the Central Probation Office;
e) covers the projects of the normative acts, including orders, provisions, agreements and contracts submitted for signature to the head of the Central Probation Office;
f) participates in the preparation of proposals for the improvement of the state management in public administration and improvement of the work basic functions, duties and rights of the Central Probation Office;
g) participates in the elaboration of the international treaties, performs legal expertise to draft international treaties at the request of the head of the Central Probation Office;
h) generalizes jointly with other structural subdivisions application of legislation of the Republic of Moldova, develops proposals to improve them and submits them for examination to the leadership of the Central Probation Office;
i) participates in drafting projects of the international treaties, at the disposal of the head of the Central Probation Office and performs legal expertise to the projects of the international treaties;
k) participates in the work performed by other structural subdivisions, on the selection and presentation, as established by law, normative acts of the Central Probation Office for legal expertise and, where appropriate, state registration at the Ministry of Justice;
l) represents, as established, the interests of the Central Office in courts and other bodies;
m) performs the systematization and record of the legislative acts;
n) performs from the methodical point of view, the management of the legal activity of the territorial subdivisions of the Central Probation Office;;
o) provides legal assistance to the structural and territorial subdivisions of the Central Probation Office on issues arising within their activity;
p) prepares for the head of the Central Probation Office, informative materials on legislation;
r) draws up the normative acts drafts;
s) prepares for publishing the textbooks and collections of laws on matters within the competence of the Central Probation Office;
t) performs other functions in accordance with the Regulation on the organization and functioning of the Legal Service of the Central Office of Probation.
The Legal Directorate has the right to:
a) require from the structural and territorial subdivisions of the Central Office of Probation, the information and other documents necessary for the execution of its duties;
b) train with the consent of the head of the structural subdivisions of Central Probation Office, employees of these subdivisions, in drafting the normative acts, as well as development and implementation of the measures conducted by the legal directorate according to the functions within its competence;
c) attend the meetings / sessions convened by the probation office and / or other governmental or nongovernmental organizations where are being discussed issues related to application of the legislation of the Republic of Moldova;
d) refuse to put into the Legal Directorate’ charge the functions and duties which do not relate to the legal activity;
e) exercise other rights provided by the legislation of the Republic of Moldova.
